Customer Terms
The short version
- You are buying from the shop, not from NOY. NOY is the software the shop uses to take your order.
- Your money goes straight to the shop. NOY never holds it and cannot refund it.
- Pay promptly. Your order is held for a short time while your payment comes through. If it does not arrive, the order is released.
- Questions about your food, your refund, or your delivery go to the shop. They can act; we cannot.
- Nothing here takes away your rights under the Consumer Act of the Philippines.

1. Who you are dealing with
When you order through a NOY page, your contract is with the shop whose name and logo are on the page. They cook the food, take your money, set the prices and issue any receipt.
NOY is the software they use. NOY is operated by KEK I.T. Solutions, a sole proprietorship registered with the Philippine Department of Trade and Industry, of Mohon, Talisay City, Cebu. We are not the seller, not an agent for the seller, and not a marketplace that takes a cut of your order.
2. Placing an order
- Prices shown include what the shop has set. Any delivery or packaging charge is shown before you confirm.
- Your order is an offer to buy. It becomes a contract when the shop accepts it, which for an online order is when they confirm your payment and start preparing it.
- A shop can refuse or cancel an order, for example if a dish has run out, if they are closing, or if the payment does not clear. If they cancel after you have paid, they must refund you.
- Some dishes sell out during the day. Anything sold out is marked, but stock can change between the moment you look and the moment you confirm.
3. Paying, and the hold on your order
You pay the shop directly through your own bank or e-wallet app, or in cash at the counter. NOY does not process, hold or move your money and never sees your card details, your bank login or your one-time PIN.
For an online order paid by transfer:
- You send the total to the shop's account using the details or QR code shown.
- You type the reference number from your receipt, or upload a screenshot of it, so the shop can find your payment in their own bank record.
- A member of staff checks it against that record and then approves the order.
Your order is held for a short window while you pay, shown as a countdown on the screen. The length is set by the shop and is typically around ten minutes.
Once you have given proof of payment, the countdown stops. There is also a grace period after the countdown for a payment that is slow to come through. If no proof of payment arrives by the end of that grace period, the order is released and cancelled so the shop is not holding food for a sale that never happened.
If your order is cancelled but you did in fact pay, contact the shop straight away. They can see the payment in their own bank record and put it right.
Staff decide whether a payment has arrived. The software shows them your reference and your image and flags obvious duplicates, but it does not and cannot confirm a bank transfer by itself. Do not send an altered or reused receipt; it is a real fraud and the shop may report it.
If you pay less than the total, the shop may still accept the order and collect the balance when you arrive. That is their decision.
4. Cancelling, changing and refunds
- Ask the shop. They can amend or cancel an order that has not been cooked yet.
- Refunds are made by the shop, from the account you paid into, in the way they choose. NOY has no ability to issue a refund and no access to the shop's money.
- Prepared food is generally not returnable once cooked, unless there is something wrong with it. Your rights under the Consumer Act of the Philippines (RA 7394) still apply and nothing here reduces them.
5. Food, allergens and accuracy
The shop is responsible for the food. That includes ingredients, allergens, preparation, hygiene, and anything written in the menu description.
If you have an allergy or a dietary requirement, speak to the shop directly before ordering. A note typed into an order is a request passed to the kitchen. It is not a guarantee, and NOY cannot check it.
Photographs are illustrations of the dish, not a picture of the exact portion you will receive.
6. Pick-up and delivery
- Pick-up: collect at the shop. They will call your order number or your name.
- Delivery: arranged and carried out by the shop, or by a rider they use. NOY does not provide, employ, arrange or insure delivery, and does not track riders.
- Give a delivery address and a working mobile number. If nobody can be reached at the address, the shop decides what happens next.
- Times given are estimates, not promises.
7. Using the ordering page properly
Please do not:
- Place orders you do not intend to pay for, or submit large numbers of orders to disrupt a shop.
- Submit a payment reference or receipt image that is not yours, is altered, or has already been used.
- Try to interfere with the page, the database, or another person's order.
- Upload anything unlawful, offensive, or containing another person's private information.
A shop may refuse service, and we may block a device, where this happens.
8. Your information
What we collect and why is set out in full in the Privacy Policy. The essentials: we collect your order, an optional name, a delivery address and mobile number only if you chose delivery, and the payment reference or receipt image you provide. The shop you ordered from decides what happens to that information, and NOY handles it on their behalf. We do not sell it and there is no advertising on the ordering page.
9. What NOY is and is not responsible for
We are responsible for providing the ordering software with reasonable care and skill, keeping your information secure as described in the Privacy Policy, and showing you accurately what the shop entered.
We are not responsible for the food, the price, the shop's service, a payment you sent to the shop, a refund the shop owes you, or a delivery. Those are the shop's, and they are the party you contracted with.
The ordering page is provided as it is. We do not guarantee it will always be available, and a shop can always take your order in person. Nothing in these terms limits any liability that cannot be limited under Philippine law, including liability for fraud, gross negligence, death or personal injury.
10. Complaints
- The shop first. For anything about your order, your money or your food, they can act immediately and we cannot.
- Then us, if the problem is with the software itself, or if the shop will not respond: [email protected]. We will acknowledge within 5 working days.
- Then the authorities, if it is still not resolved. Consumer complaints may be brought to the Department of Trade and Industry. Privacy complaints may be brought to the National Privacy Commission at privacy.gov.ph.
11. Governing law
These terms are governed by the laws of the Republic of the Philippines. Nothing in them removes or reduces any right you have as a consumer under Philippine law, including under the Consumer Act of the Philippines (RA 7394) and the Electronic Commerce Act (RA 8792).
